1. Conclusion of Contract and Payment
The rental agreement is concluded by sending the reservation form or by making a reservation by phone.
From the time of reservation, a period of 10 days applies for the deposit:
- For reservations of more than 7 overnight stays: 20% deposit
- For reservations of 8 overnight stays or less: total amount (100%)
Only after receipt of the aforementioned payment is the reservation binding for both parties.
For reservations of more than 7 overnight stays, the remaining amount is due no later than 56 days (8 weeks) before the start of the rental period.
The deposit can be made by bank transfer or via PayPal.
2. Subletting and Mediation
In principle, it is not permitted to sublet or mediate the rental agreement to third parties. If the orderer is not simultaneously the user or orders at the expense of another, both are liable as joint debtors.
3. Occupancy of the Rental Property
The contractual object may only be occupied by the number of persons specified in the contract. In the event of over-occupancy, the landlord, without prejudice to our right to terminate the contract, is entitled to demand an additional reasonable fee for the period of over-occupancy. The excess persons must leave the property immediately.
4. Careful Treatment of the Rental Property
The tenant agrees to treat the property carefully and to report any damages and defects to the landlord immediately during the occupancy period, also for their fellow travelers.
5. Cancellation
In case of travel impediment, the tenant must cancel the reservation in writing.
Cancellation Fees:
- From the booking date up to 90 days before the start of the rental: 20% of the confirmed rental costs
- From 89 days to 60 days before the start of the rental: 40% of the confirmed rental costs
- From 59 days to 36 days before the start of the rental: 70% of the confirmed rental costs
- From 35 days before the start of the rental: 100% of the confirmed rental costs
- Without prior cancellation: 100% of the confirmed rental costs
6. Early Departure and No-Show
In the event of early termination of the rental relationship or no-show, the tenant has no claim for compensation for the unused rental days.
7. Alternative Rental
The landlord is obliged in good faith to reallocate the unused rental period of the apartment if possible to avoid losses. Until the apartment is reallocated, the guest must pay the calculated amount for the duration of the contract.
It is advisable to take out travel cancellation insurance.
8. Liability for Damages
The tenant/contract partner is liable for all damages caused by them and/or their fellow travelers to the rental property, the inventory, and the communal facilities, e.g., broken dishes, stains on carpets, or damage to furniture.
This also includes the costs for lost keys, e.g., for locking systems or safes.
Identified damages and all other complaints must be reported to the landlord within 24 hours.
9. Arrival
On the day of arrival, the tenant can access the rental property no earlier than 3:00 PM. The tenant cannot assert claims for damages if the rental property is exceptionally not available at 3:00 PM.
10. Departure and Final Cleaning
The holiday property must be left broom-clean by 10:00 AM on the day of departure. Dishes, glasses, etc. must be cleaned, trash bins emptied, and the refrigerator cleared out.
If this is not done, we will charge an additional cleaning fee of €50.
11. Side Agreements and Changes
No oral or written side agreements have been made. Changes or additions require written form to be legally effective. The same applies to the waiver of the written form requirement.
12. Severability Clause
If individual points of these terms and conditions are ineffective or void, this does not affect the legal effectiveness of the remaining contractual contents.
The two contracting parties agree to replace the legally ineffective provision with a legally effective one that comes closest to the economic purpose and the intended content of the invalid one. Otherwise, the statutory provisions apply.
13. Jurisdiction and Applicable Law
The jurisdiction for all disputes arising between the parties from the contractual relationship is El Paso / S/C de Tenerife, Spain. Spanish law applies.
